These terms

These terms govern your use of the Optics Studio website at optics.studio. By accessing the site you confirm that you have read, understood, and agree to be bound by them; if you don’t agree with any part, please don’t use the site. If you use the site on behalf of an organization, you’re agreeing on its behalf and confirming you have the authority to do so.

Client engagements — the design work itself — are governed separately by the proposal or agreement we sign for that work, not by this page.

Changes

We may revise these terms from time to time; the current version is always the one posted here, applying from the date shown above. Continuing to use the site after a revision takes effect means you accept the revised terms.

Using the site

You may use the site only in compliance with these terms and all applicable laws. In particular, you must not:

• violate any applicable law or regulation;
• distribute viruses, malware, or anything else designed to harm the site or its visitors;
• scrape, spider, or crawl any part of the site without our permission; or
• interfere with or disrupt the site, its infrastructure, or anyone’s use of it — for example by overloading, flooding, or spamming it.

Material you send us

You’re responsible for anything you choose to send us through the site or by email, and for having the right to share it. Don’t send us material you aren’t authorized to share; we aren’t liable for our use of material you send us in accordance with these terms.

Intellectual property

Unless we’ve explicitly authorized it in writing, you may not reproduce, modify, sell, distribute, mirror, frame, republish, or create derivative works from the site’s content, or use it for commercial purposes.

Termination

We may suspend or end your access to the site at any time, without notice or liability, for any reason — including a breach of these terms. On termination, your right to use the site ends immediately.

Disclaimers

The site is provided “as is.” To the fullest extent permitted by law, Optics Studio and its suppliers and licensors disclaim all warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that the site will be error-free or that access will be continuous or uninterrupted.

Limitation of liability

To the extent the law allows, Optics Studio and its suppliers and licensors will not be liable, under any contract, negligence, strict-liability, or other legal theory, for (i) any special, incidental, or consequential damages; (ii) the cost of procuring substitute products or services; or (iii) interruption of use or loss or corruption of data arising from your use of the site.

Your representations

You represent and warrant that your use of the site will comply with our privacy policy, these terms, and all applicable laws and regulations — including those of the place you live — and that it will not infringe or misappropriate anyone else’s intellectual property rights.

Indemnification

You agree to indemnify and hold harmless Optics Studio, its contractors, and its licensors, and their respective directors, officers, employees, and agents, from any claims and expenses — including reasonable attorneys’ fees — arising out of your use of the site, including any violation of these terms.

Entire agreement

These terms are the entire agreement between you and Optics Studio about your use of the site. They can be changed only by a posted revision to this page or a written amendment signed by Optics Studio.
